| 英文摘要 | The category of free appointment and removal jobs has become a major misunderstanding in the Colombian legal system. This seems to be due (1) to certain deficit or confusion of its justification and conceptual delimitation, justification that compels to understand the power of free appointment and removal as a form of political function, rather than an administrative function. The dogmatic inconsistency that involves the ignorance of the political nature of the aforementioned power translates (2) in an inappropriate formulation of requirements for the correct exercise of this attribute. Such requirements include that decision to withdraw from service must be supported by the principle of proportionality, and that reasons for disengagement must be recorded in public servants' resumes. This, despite the fact that the act of removal does not require motivation ; and even more serious, (3) that the aforementioned power could become deserted. This could have a harmful impact on the proper functioning of State entities, since free employment appointment and removal is now subject to assumptions of reinforced labor stability or social charges recognized by regulations and jurisprudential developments. |
