| 英文摘要 | This article explores women's uses of Islamic legal institutions in the Tuwat oases in southern Algeria during the eighteenth and the nineteenth centuries. It challenges the common view of Islamic law as an essentially urban phenomenon that stood in contrast to rural customary law and offers an anthropological analysis of women as social actors in Islamic courts in pre-modern North Africa. Empirically, our research is based on the close examination of a series of unedited collections of casuistic jurisprudence (nawazil) compiled by local scholars between 1750 and 1850. The materials conserved in these collections allude to a profound ambiguity that characterized female agency in pre-modern tuwati society. On one hand, Islamic legal institutions allowed women to claim rights and defend economic interests and, on the other, they worked as powerful devices for perpetuating patriarchal social structures. |
